The Service allows you to discover, watch videos and other content, provides a place of discovery, a place where for creatives and their community of fans can discover and connect in a new interactive way!

Who may use the Service?

Age Requirements: You may use the Service if you are at least 13 years old.

Children of all ages may use Viktrs Kids (where available) if enabled by a parent or legal guardian.

 

Viktrs doesn’t allow content that endangers the emotional and physical well-being of minors. A minor is defined as someone under the legal age of majority, usually anyone younger than 18 years old in most countries/regions!

If you find content that violates this policy, report it. If you believe that a child is in danger, you should contact your local law enforcement to report the situation immediately.

If you are under 18, you must have your parent or legal guardian’s permission to use the Service. Please have them read this Agreement with you.

If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service.

Content may be provided to the Service and distributed by our users, Viktrs is a provider of hosting services for such Content. Permissions and Restrictions

You may access and use Viktrs embedded videos as made available to you, as long as you comply with this Agreement and the law. You may view or listen to Content for your personal, non-commercial use.

The following restrictions apply to your use of the Service. You are not allowed to:

• Break, attempt to break or circumvent our security measures or otherwise test the vulnerability of our systems or networks

• Use any method to access, search, scrape, download or change Viktrs or Viktrs data or anything on it

• Use Viktrs’s name, logo, trademark or branding without our consent (our brand guidelines tell you how to use these things)

• Access, tamper with or use non-public areas of Viktrs, our systems or our technical providers’ systems

• Access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any Content except:  (a) with prior written permission from Viktrs and, if applicable, the respective rights holders; or (b) as permitted by applicable law;

• Circumvent, disable, fraudulently engage, or otherwise interfere with Viktrs embedded videos (or attempt to do any of these things), including security-related features or features that: (a) prevent or restrict the copying or other use of Content; or (b) limit the use of the Service or Content;

• Use Viktrs user information to forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use Viktrs to send altered source-identifying information

• Try to reverse engineer any of Viktrs’s software

• Try to interfere with any Viktrs user, host or network, for example by sending a virus, overloading, spamming or mail-bombing

• Collect or store personally identifiable information from Viktrs or its users without their permission

• Impersonate or misrepresent your affiliation with any person or entity, including Viktrs

• Create or show ads that look like or could be confused with Viktrs content

• Collect or use any information that might identify a person (for example, harvesting usernames), unless permitted by that person;

• Use the Viktrs to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations (spam);

• Cause or encourage any inaccurate measurements of genuine user engagement with Viktrs, including by paying people or providing them with incentives to increase a video’s views, likes, or dislikes, or to increase a channel’s subscribers, or otherwise manipulate metrics;

• Misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions;

• Use the Service to view or listen to Content other than for personal, non-commercial use (for example, you may not publicly screen videos or stream music from Viktrs without explicit consent from the rights holder and Viktrs)

 

We may make changes to this policy from time to time without notice and for any reason Viktrs deems reasonable, but will always consider and balance the impact of such changes on the use of the Service.. However, whenever reasonably possible, we will provide notice when we discontinue or make material changes to our Service that will have an adverse impact on the use of our Service. However, there will be times when we need to make such changes without notice, such as where we need to take action to improve the security and operability of our Service, prevent abuse, or meet our legal requirements.

Submit a copyright takedown notice

If your copyright-protected work was posted on Viktrs without authorization, you may submit a copyright infringement notification. Be sure to consider whether fair use,  fair dealing, or a similar exception to copyright applies before you submit. These requests should be sent by the copyright owner or an agent authorized to act on the owner’s behalf.

This will start a legal process. If you can give us a valid legal alternative, such as a company name or the name of an authorized representative, we'll review and apply it if appropriate. The name will become part of the public record of your request, along with your description of the work(s) allegedly infringed. All other information, including your full legal name and email, are part of the full takedown notice, which may be given to the uploader.

 

Security

We care about the security of our users. While we work hard to protect the security of your content and account, Viktrs cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.

Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Viktrs. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Viktrs, you do so at your own risk and you agree that Viktrs will have no liability arising from your use of or access to any third-party website, service, or content.

The Products and all included content are provided on an “as is” basis without warranty of any kind, whether express or implied.

VIKTRS SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Viktrs takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our Products. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIKTRS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PRODUCTS, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
